GENERAL CONDITIONS OF SALE

These Conditions of Sale regulate the offer and sale to the consumer of products through the website pastaraguso.it (the “Site”) owned by the Vera agricultural cooperative society and are planned and provided in compliance with Legislative Decree no. 2016 (so-called “Consumer Code”) and any other law applicable to electronic commerce.

It is your right to request additional information through our help services by contacting the Customer Service.

1. THE CONTRACT - COMMERCIAL POLICY

The parties to the contract are:

- Vera agricultural cooperative company (“Vera”), with a registered office in Genzano di L., C.da Ripa D’Api sp 139 km 1,500, Companies Register of the Chamber of Commerce of Potenza under no. REA PZ- 150305, Tax Code and VAT number 07387320729;

- The “Customer” or “Consumer”: the ultimate consumer, or any natural person who makes purchases through the Site for purposes other than his own commercial, entrepreneurial or professional activity possibly carried out;

Vera offers its products for sale on the Site and carries out e-commerce activities only for its end users, who are “final consumers” as defined above. In consideration of this commercial policy, we therefore reserve the right not to process orders from subjects other than the Consumer. If you are not a consumer, we therefore invite you to not conclude commercial transactions on the Site.

Vera sells its products through the Site only and only on the Italian territory. Vera can not accept and execute purchase requests that include a delivery address outside the Italian territory.

The language available to conclude the contract with Vera is Italian.

These Conditions of Sale do not regulate the supply of services or the sale of products by parties other than Vera, who may be present on the Site through links, banners or other hypertext links. Before placing orders and purchasing products and services from subjects other than Vera, we advise you to check their conditions of sale, because Vera is not responsible for the provision of services by such subjects or for the conclusion of e-commerce transactions between the users of the Site and third parties.

2. APPLICATION AND MODIFICATIONS OF THE CONDITIONS OF SALE

Before making purchases through the Site, the Customer declares to have read and understood these Conditions of Sale as well as all the information provided during the purchase procedure and the contents of the following sections: Terms of use, Privacy Policy and to accept them in full without reservation. .

Vera reserves the right to change the contents of these Conditions of Sale and the other documents listed above, highlighting them within the Site. We therefore invite you to periodically consult the Site to check for any updates or changes. Any changes will be effective after publication on the Site.

The Conditions of Sale applicable to a purchase will always be those in force at the time we placed the relative order.

3. CHARACTERISTICS AND PRICES OF THE PRODUCTS

Vera offers for sale on the Site only products marked by trademarks owned by them and / or licensed to it or with the authorization of their respective owners. Vera does not sell used, irregular, or inferior quality products on the Site to the corresponding standards offered on the market.

We presented the essential characteristics of the products on the Site within each product sheet. The images and colors of the products offered for sale on the Site may, however, change and / or not exactly correspond to the real ones because of the Internet browser and monitor used.

The products are offered for sale at the price showed on the Site at the time we placed the relevant Purchase Order (see below). Product prices may be subject to changes and variations. We invite you to check the last sale price before submitting the relevant order form, thus confirming the purchase.

The prices showed on the Site must be understood as inclusive of VAT and, unless showed, do not include any additional costs for shipping and delivery which, where applicable, are made known to the Customer through specific indications on the Site and specifically referred to in the course. of the purchase procedure.

4. METHOD OF CONCLUSION OF THE CONTRACT

To purchase one or more products on the Site, the Customer must complete and electronically transmit the respective order form to Vera (“Purchase Order”) following the instructions progressively provided during the purchase procedure. We clearly described all phases of the purchase procedure through the pages of the Site and the related texts and graphics.

The Purchase Order, displayed in its entirety immediately before the conclusion of the contract and before any payment is made, provides summary information about the essential characteristics of each product ordered, the price (including all taxes or applicable taxes) and any applicable shipping costs and / or charges.

With the electronic transmission of the Purchase Order, the Customer unconditionally accepts and undertakes to observe these Conditions of Sale in relations with Vera regarding the purchase. If you do not agree with some terms set out in the Conditions of Sale, we therefore invite you not to submit the Purchase Order.

Following the receipt of the Purchase Order, Vera will check the availability of the ordered product and will send the Customer by e-mail a confirmation of receipt containing these Conditions of Sale, including the provisions relating to the right of withdrawal, and therefore all the information already contained in the summary of the commercial and contractual conditions displayed before sending the Purchase Order.

The sales contract is concluded and perfected when Vera sends the Customer the confirmation of receipt of the Purchase Order completed and sent by the Customer electronically, after verifying the correctness of the data provided and transmitted.

We will file the Purchase Order in our database for the time necessary for processing and, in any case, not beyond the terms of the law.

Vera reserves the right not to process Purchase Orders that are incomplete or incorrect or inconsistent with the commercial policy referred to in paragraph 1 of these Conditions of Sale, as well as in the event of unavailability of the ordered products. In these cases, we will inform you that the contract has not been concluded and that Vera has not followed up the Purchase Order, specifying the reasons.

In particular, if the products presented on the Site are no longer available or on sale at the time of your access to the Site, or at the time of sending the order form, Vera will promptly notify you of any unavailability of the Products. In such cases, the contract will not be completed and, if already concluded for any reason, it will be automatically ended and we will charge no amount to you.

Any contractual or extra-contractual liability for direct or indirect damage to persons and / or things caused by the non-acceptance of an order for the above reasons is expressly excluded.

5. RESERVATION OF PRODUCTS

Through the “Book Product” service you can purchase any products not available at the time of the transmission of the Purchase Order, which Vera undertakes to ship once available.

Once the Purchase Order has been electronically received by a reservation filled in and transmitted by you and after verifying the correctness of the data provided and transmitted, Vera will send within one day of the conclusion of the procedure an e-mail communication containing information about the product availability, shipping and delivery.

By sending the aforementioned communication, we will deem the purchase contract finalized.

For anything not specifically described in this paragraph, these Conditions of Sale are reserved and will apply.

6. SHIPPING AND DELIVERY

The products purchased through the Site will be delivered by Vera by courier to the address indicated in the Purchase Order within 10 (ten) working days from the time we conclude the contract.

If the products purchased through the Site are limited editions, or we concluded the related contract as part of promotional initiatives, during prize events or temporary initiatives of any kind, Vera does not guarantee delivery within the terms stated above.

In these cases, the delivery period may vary according to the availability of the product or the characteristics of the promotion. Vera will appropriately communicate these changes on the Site and / or by sending e-mails or other methods of communication.

If the courier cannot deliver for any reason, he will leave a notice of passage showing the useful numbers to set a new delivery date. The courier delivers from Monday to Friday from 9:00 to 18:00.

7. PAYMENTS

We can make payment for orders:

(i) by credit card belonging to the Visa / MasterCard / American Express circuit;

(ii) through the Paypal platform, selecting it during the purchase procedure, you will be redirected to the secure Paypal servers where, by logging in with your credentials, you can complete the payment by charging your credit card, current account or electronic purse.

In case of payment by credit card, we will charge the price for the purchase of the products and any shipping costs at the time of shipment of the purchased products.

In case of payment with Paypal, the actual charge will take place when Vera sends the order confirmation e-mail

The financial information (for example, the credit / debit card number or its expiry date) will be forwarded, via encrypted protocol, to the banks that provide the related remote electronic payment services, without third parties being able. , have access to it. Vera will never use this information except to complete the procedures relating to your purchase and to issue the related refunds in the event of any product returns, following the exercise of your right of withdrawal, or if it becomes necessary. Prevent or report to the police the commission of fraud through the Site.

Before completing the order, you may request the issuance of a tax invoice as showed during the purchase procedure. It will not be possible to request an invoice once the procedure has been completed and we have sent the relevant Purchase Order.

8. RIGHT OF WITHDRAWAL (Article 52 et seq. Legislative Decree No. 206 of 6 September 2005)

Alternatively, the communication can be sent, within the same term, by e-mail (info@pastaraguso.it).

The withdrawal is effective only if exercised no later than 30 days from delivery of the products. Vera as soon as received the communication of the withdrawal will, without delay contact the Customer by telephone in order to communicate the address of the place where the products must be returned; the Consumer will then take care of the return of the products to Vera under these indications no later than the following 14 days. Vera, within the times and methods agreed with the Customer, will fully refund the amount paid by the Customer. We charge the costs of returning the products to Vera to the customer.

An essential condition for exercising the right of withdrawal is the substantial integrity of the products to be returned.

9. LEGAL GUARANTEE OF CONFORMITY

Under Title III, Part IV of Legislative Decree 206/2005 (so-called Consumer Code) Vera guarantees the products purchased on the Site are free from defects for two years from delivery, without prejudice to all the rights and remedies because of the consumer in application of the rules of the Consumer Code, including the right to restore without expenses by repair or replacement and, alternatively, the other remedies provided for by art. 130 of the Consumer Code. By “defect” we mean a significant limitation or reduction of the suitability for use of the product under art. 129 of the Consumer Code. This warranty does not cover all defects resulting from negligent or improper use of the product. The defective product, if still covered by warranty, must be sent to the service center together with a copy of the documents suitable to certify the purchase and the delivery date. 10. WITHDRAWAL OF USED PRODUCT OF AN EQUIVALENT TYPE (Article 22 of Legislative Decree 49/2014).

In compliance with Legislative Decree 14 March 2014, n. 49, Vera soc coop agr (Vera), for the supply to a household of a new electrical equipment (AEE) produced by Vera, following an order placed by the consumer with any remote communication technique, offers the withdrawal free, on a one-to-one basis, of used electrical equipment to be disposed of as waste, provided that it is of an equivalent type to the new equipment supplied (WEEE equivalent). Vera will carry the collection of the equivalent RAAE out at the place of delivery of the new product and will take place after the delivery of the latter. To take advantage of the free collection of the equivalent WEEE, the Consumer must communicate his will when ordering the new product, by contacting Vera by: E-mail: info@pastaraguso.it The quantity of equivalent WEEE withdrawn cannot be greater than the quantity of products of the same type purchased. Vera, having verified the existence of the request and the supply order for the new EEE, will manage the collection of the equivalent WEEE within 30 days from the order, using allowed suppliers who will contact the Consumer to agree on the date of withdraw. On the agreed date, the Consumer must ensure that the equivalent WEEE is ready for collection (unplugged, clean, etc.). The collection can be refused if there is a risk of contamination of the personnel responsible for the same collection or if the equivalent WEEE does not contain its essential components or contains waste other than WEEE. It reminded the Consumer of the possibility of delivering all the WEEE to the ecological islands in his own municipality. Tiny WEEE (external dimensions of less than 25 cm) can also be delivered free, even without purchasing a new product of an equivalent type, at specialized sales points with an area of at least 400 square meters intended for electrical equipment and at the other points of sale that have voluntarily activated this service.

13. APPLICABLE LAW

The Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 (so-called Consumer Code), with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning trade.

The competent court for resolving any dispute will be that provided for by the Italian legislation in force at the time of the conclusion of the contract.
